[This is required by law, including certain provisions of the Federal Employment Age Discrimination Act (ADEA) that provide that these compensation agreements must be respected either 21 or 45 days before signing and 7 days after signing if the separated worker is 40 years of age or older. This ADEA law also requires an explanation in the agreement that the employee can seek the assistance of a lawyer to verify the agreement.] [Sometimes a whole new confidentiality and confidentiality provision will be taken into account in the severance agreement, in this case because the employment provided that the severance pay actually functioned as a new consideration for that confidentiality.] Another red flag to watch out for is a language that is confused, wide or vague. It is important that you understand exactly what rights you are waiving and what obligations you are assuming. Courts typically consider two aspects of a severance agreement to determine if it is not serious:24 If you are unsure whether the waiver declarations in your severance agreement are valid or legally applicable, you discuss the terms of the agreement with an experienced California professional or contract lawyer.
